„Beratungskulturen“: zur internen Arbeit von Verfassungsgerichten
In ihrem Buch „Beratungskulturen“ thematisiert Gertrude Lübbe-Wolff, in den Jahren 2002 bis 2014 Richterin am Bundesverfassungsgericht in Karlsruhe, die interne Art und Weise der konkreten, alltäglichen Arbeit von Verfassungsgerichten. Die zentrale Frage des Bande ist die nach den Bestimmungsfaktoren der richterlichen Entscheidungen, denn jede konkrete Entscheidungsprozess ist eingebunden in eine Vielzahl von systematischen und strukturellen Rahmenbedingungen, die diese Entscheidungsfindung (mit)prägen. Und doch geht der Band über reine „Beratungskulturen“ hinaus, berücksichtigt werden auch die Wahlverfahren der Mitglieder der jeweiligen Gerichte, deren Amtszeit und Wiederwahlmöglichkeit, die Rolle der jeweiligen Mitarbeiter/innen und nicht zuletzt auch räumliche und technische Aspekte der Arbeit von Verfassungsgerichten. In ihrer Untersuchung geht Lübbe-Wolff international vergleichend vor, der Schwerpunkt liegt dabei auf dem deutschen Bundesverfassungsgericht und auf dem US-amerikanischen Supreme Court. Januar 2023 findet sich eine sehr ausführliche Rezension des Buches durch den Berliner Staatsrechtler Christoph Möllers (Humboldt-Universität).
