1987 hatte ihn der damalige Präsident Ronald Reagan als Richter am höchsten Gericht der Vereinigten Staaten nominiert, und nach einem mehrtägigen Anhörungsmarathon im Senat unter dem Vorsitz des damaligen Rechtsausschussvorsitzenden Joe Biden (D-Delaware) musste Reagan seine Nominierung zurückziehen. Schon damals war die Ernennung von Richtern für den Supreme Court eine augenscheinlich sehr schwierige Angelegenheit. Die Auswirkungen der gescheiterten Bork-Nominierung sind nach Auffassung vieler Beobachter bis heute zu spüren. Zuletzt fungierte Bork als Berater der Präsidentschaftskampagne von Mitt Romney.
