In Kürze auch in Ihrer Nähe: Das Instrument der europäischen Bürgerinitiative
Mit dem Vertrag von Lissabon ist es nunmehr möglich, auf europäischer Ebene ein Volksbegehren zu starten. Die SPD will dieses Instrument nun erstmals anwenden, und zwar in Bezug auf die Regulierung des Finanzmarktes (Stichwort „Spekulationssteuer“). Für den Erfolg dieses Begehrens werden mindestens eine Million Stimmen aus neun unterschiedlichen Mitgliedsländern benötigt. Die EU-Kommission würde in diesem Fall aufgefordert, einen entsprechenden Gesetzesvorschlag auszuarbeiten. Wir kommen im Laufe des Seminars sicher noch auf dieses Instrument zu sprechen.

Im Unterschied zu einem Volksbegehren, bei dem die Initiatoren im Falle einer Ablehnung des Bundes- oder eines Landtags die Möglichkeit haben, einen Volksentscheid zu initiieren, ist die Europäische Bürgerinitiative (EBI) doch eine recht stumpfe Waffe.
Sollte die Kommission nicht von der Möglichkeit Gebrauch machen, einen Gesetzesvorschlag im Sinne der EBI zu unterbreiten, so würde hier die Möglichkeit fehlen, einen Bürgerentscheid auf europäischer Ebene durchzuführen.
Und das die Kommission den Vorschlag der EBI „ablehnt“ ist meiner Meinung nach nicht unwahrscheinlich, da die EU bislang in Sachen Demokratie noch viele Schwächen aufweist, auch wenn diese durch den Reformvertrag an einigen Punkten abgemildert wurden. (bei anderen Punkten ist indes das Gegenteil der Fall)
Jedenfalls ist Art. 11 Abs. 4 EU-Vertrag ziemlich unverbindlich und lässt viel Spekulationsspielraum.
