Schon damals war die Ernennung von Richtern für den Supreme Court eine augenscheinlich sehr schwierige Angelegenheit. Die Auswirkungen der gescheiterten Bork-Nominierung sind nach Auffassung vieler Beobachter bis heute zu spüren. Zuletzt fungierte Bork als Berater der Präsidentschaftskampagne von Mitt Romney.
