Muss die Europawahl 2009 wiederholt werden?
Im laufenden Semester haben wir uns im Aufbaumodul Systemanalyse und Vergleichende Politik mit dem politischen System der Europäischen Union (EU) auseinandergesetzt. Zum Gegenstand des Seminars gehörte auch das Europäische Parlament, dessen Abgeordnete im Frühsommer 2009 (neu) gewählt wurden.Der Verfassungsrechtler Hans Herbert von Arnim hat nun, unterstützt von weiteren 30 Staatsrechtlern und 500 Bürgern, vor dem Bundesverfassungsgericht Klage eingereicht, weil er die Wahl für verfassungswidrig hält. Seine Kritik zielt insbesondere auf die 5-Prozent-Klausel und auf die starren Parteilisten.

Dies hat das Bundesverfassungsgericht mit Urteil vom 09.11.2011 entschieden. Die Sperrklausel verletze die Grundsätze der Wahlrechtsgleichheit und der Chancengleichheit der politischen Parteien. Es sei nämlich davon auszugehen, dass das Parlament auch dann funktionsfähig bleibe, wenn die Klausel wegfalle und kleineren Parteien damit der Einzug ins Parlament erleichtert werde (Az.: 2 BvC 4/10, 2 BvC 6/10, 2 BvC 8/10).
