Ruth Bader Ginsburg gestorben
Mit 87 Jahren ist vorgestern Ruth Bader Ginsburg gestorben. Seit ihrer Berufung an den Supreme Court der Vereinigten Staaten durch Präsident Bill Clinton im Jahre 1993 war sie für 27 Jahre eine der wichtigsten Figuren an diesem Gericht. Sie war „Ikone, Pionierin, Frauenrechtlerin: Ruth Bader Ginsburg war der Star des Supreme Courts – und Hoffungsträgerin von Millionen Amerikanern. Ihr Leben brach Schranken, ihr Tod ist mehr als ein Politikum“ – wie der SPIEGEL anlässlich ihres Todes schrieb (mehr hier beim Berliner Tagesspiegel).
Die New York Times hat eine ganze Reihe von Artikeln zu ihrem Tode zusammengestellt, darunter eine ausführliche Biografie, eine Fotostrecke zu ihren Lebensstationen, ein Blick auf ihre wichtigsten Themen und Urteile sowie auch eine Analyse der Frage, was ihr Tod für den laufenden Präsidentschaftswahlkampf zwischen Donald Trump und Joe Biden bedeutet.
Schaut man auf die beidenen vergangenen Supreme-Court-Berufungen Donald Trumps zurück, so zeigt sich, dass eine Neuberufung das Potential hat, auf beiden Seiten Wählerinnen und Wähler zu mobilisieren. Wenn man zudem bedenkt, dass Richterinnen und Richter auf Lebenszeit berufen werden, ist nur schwer abzuschätzen, welchen Einfluss eine neu berufene Richterin (und Trump hat bereits angekündigt, eine Frau berufen zu wollen) auf die amerikanische Politik der nächsten Jahre und Jahrzehnte haben wird – Einfluss jedenfalls, der deutlich über die Amtszeit des amtierenden Präsidenten hinausreichen dürfte, unabhängig davon, ob Trump bis 2021 oder 2025 amtieren wird. Vermutlich dürfte die konservative Dominanz des Gerichts (bei gerade einmal neun Richterinnen und Richtern) auf absehbare Zeit gefestigt werden.
Eines gilt es im Hinterkopf zu behalten: als im Februar 2016 der (sehr konservative) Richter Antonin Scalia verstarb und der damalige Präsident Barack Obama mit Merrick Garland einen neuen (eher gemäßigten) Kandidaten vorschlug, verweigerten die Republikaner im Senat Garland eine Anhörung im Justizausschuss (die Vorbedingung für eine Abtimmung in Ausschuss und Plenum ist) so lange, bis neun Monate später Donald Trump die Wahl gewann und seinerseits mit Neil Gorsuch einen (sehr konservativen) Kandidaten vorschlug, der schlussendlich auch vom Senat bestätigt wurde. In der akuellen Situation scheinen die Republikaner bestrebt zu sein, noch vor den Wahlen Anfang November eine Neubesetzung erreichen zu wollen, womit sie ihre damalige Position konterkarieren. Am Ende wird es wohl auf den Mehrheitsführer der Republikaner im Senat, Mitch McConnell (Kentucky) und dessen Strategie in diesem Nominierungsverfahren ankommen (Details hier). Aktuell verfügen die Republikaner über 53 der 100 Senatssitze, am Ende würden sie 50 Sitze für eine Nominierung der neuen Richterin benötigen, da bei einem Gleichstand Vizepräsident Mike Pence die entscheidende zusätzliche Stimme abgeben dürfte. Kurz: es bleibt spannend. Und der amerikanische Präsidentschaftswahlkampf beginnt (erneut) bei Null.
Unbedingt sehenswert ist schließlich der Dokumentarfilm „RBG- ein Leben für die Gerechtigkeit“, der in der ZDF-Mediathek noch genau eine (!) Woche verfügbar ist (nämlich hier).
